Worker struck by flying metal, Montreal company fined $60,000

MISSISSAUGA, Ont. — A Mississauga, Ont. manufacturer of commercial roofing products was fined $60,000 after pleading guilty to failing to ensure a machine was properly guarded.
Lexsuco 2010 Corp. was fined by a justice of the peace in a Mississauga, Ont. court for an accident that occurred May 31, 2016.
A worker at the company’s Mississauga facility was trimming a large copper disc on a lathe to create a flashing hub approximately two inches in length. This hub would be used to connect flat roof drains to downspouts.
The cutting tool caught on the copper, tearing a large piece (called a swarf) off the disc. The swarf hit the worker, who suffered injuries.
A Ministry of Labour investigation found the spin area on the lathe was not guarded or shielded to protect the worker from the swarf as required by the Industrial Establishments Regulation (Ontario Regulation 851/90).
The court also imposed a 25% victim fine surcharge as required by the Provincial Offences Act that is credited to a special provincial government fund to assist victims of crime.
